Online piracy ruled legal by french court

The ruling from the district court is rather clear: the defendant was making use of these files for private, personal use, and thus his use was legal. According to the court, French law permits citizens to make fair use of copyrighted materials so long as that usage is not collective, or for commercial gain.

Seems we're not getting our share of "Music publisher association sues a dead grandma and a newborn for piracy" anyday.

For me..... movies, games and music are all covered under the ISPCPATHL (I support piracy cause the prices are too high law, 2001)

I have always been puzzled by this, i never understood how such law was voted in the Assembly.

But, when i investigated a bit more, i understood :
the law was accepted at 30 voices pro , 28 voices cons.
So there were 58 deputy in the whole Assembly at this hour of the night.

And there is 577 deputy elected in the Assembly in France

That means 519 deputies were in holidays, went home, go away etc... instead of working as seriously as their job is supposed to force them.

When i think about how many euros those guys are paid, the fact they don't pay any taxes unlike everyone in France, that's just hilarious, even more hilarious than that P2P law.

When i was younger, i should really have choosen "deputy" as a career/job, there are very few jobs in which you can just -not go to work- if you want , and always get paid and have all the advantages this kind of job gives you.

been a while since I had someting good to say about france, but, this is good :D

(though my heart stll lies in canada :) )

anyway, if you legaly own the rights of something, that you should be able to make copies of it. or at least 1 anyway, just in case you "breake" the media (cd/harddrive...etc...) y mistake, that way you have a LEGAL back up!

and P2P should be available for such use! aswell as sharing of other things, like "home made" files :)

Maybe that was not clear enough but i'm arguing about some people elected to make a specific work, but that do not bother to go to that work, but that continue to get their high pay and the advantages this job offer to them.
That situation can explain a very lot of the problem in France.

I know that certainly mean nothing for you, but i don't care of P2P allowed/helped/forbidden at all, i have no need of downloading videogames,movies or music, having different center of interest than these in my life , none is forcing you to download/buy any.

I also support the ISPCPATHL. But I'm more of a supporter for WTSMSWBL (When They Start Making Stuff worth Buying Law)

I'm pretty strong on this. I'm not going to pay 50$ for something that I don't know if I like or not, and then end up NOT liking it. HL2, UT2k4, FEAR, GTA were all worth my money IMO. But Black and White 2 are not. And since we can't get refunds for games these days, I support the ISPCPATHL.

Good news for France. I wish there was a law like that here... OH WAIT THERE IS :) Problem is nobody cares about Fair Use now that DMCA and other crap laws have been passed.

Although i'm happy about this court's decision, i'm not sure this is a valid argument here. It's not because major companies are trying to shove their products into the consumers' throat every way they can that we should turn this into some kind of consumer tyranny instead. When you buy something in a supermarket, you're not supposed to taste it first. I don't see why we should be allowed to try everything out before we buy it, and i'm not sure it would work well.

Actually, yes, you are allowed to taste here in France.

Also, the main reason the judge decided there was nothing wrong done, was that the files were burned to CD-Rs or stored on digital media that all have a levy paid on, that goes to artists.

It depends on your investment. If I go to the grocery store to buy a loaf of bread, I might spend $2.00 on it and if I don't like it, it's only another $2.00 to replace it.

If it's a video game, I'm often spending upwards of $40 per game. With the number of games that are out there, in order for me to try every game by buying it would cost me a fortune.

So it might cost me $20 to try every type of bread at the store and decide which one i like. But then it would cost me thousands upon thousands to buy every video game in the store to decide which ones I like.
