The escape itself isn't punishable by law in Germany or Austria. However, you or someone else needs to do illegal things for the escape to be successful. (damage to property, helping someone to escape, etc.)
Also, while law doesn't forbid escaping, you usually earn yourself some kind of disciplinary action anyway.

Then, if it had been a mostly Spanish team, we'd have implemented premature releases for Terrorists (CS version) and The Corrupt (UT version)...
