Thats why movie studies go through character names very carefully so stupid **** like this doesn't happen. He will probably win unless the judge has at minimum an ounce of intelligence.

Well, it's just a name. It isn't like they've taken the wrestler he was and put in him the game; they just used "his" name. And his name isn't that original. Max Payne. Yeah, no one else in a million years would ever think up of that, nu-uh.

If the name was something original, like for example Zaphod Beeblebrox, I could see how one could claim that the name was being stolen, but Max Payne? It's just a low-quality pun. I'm sure that he wasn't the first person in the world to every think it up.

My friend and I, when we were little, thought up of a group called the Power Rangers before the Power Rangers came out. Can we sue them? Hell, this is America. I'm sure we have a case.

I am going to start using all diffrent nick names for myself, and sue everyone that use/comes close to/thinks of using one of them....ill use the letters as my name, and say that by them using letter in the name of there movie it steals my name, and by combining more then one letter it steals more then one part of my name.....i may expand this to simple shapes as well to cover the use of symbols......my plan is fool proof!

Usually, if you read the manual in the legal bit, there's something (like movies have) about all characters are fictional, and and relation to real people is purely coincedental. I can't say if the Max Payne manual had that seeing as though I've not got it, but it's very likely that it does. So, either he can't read the manual, or he pirated the game.

But still, just the thought of someone really trying this on...

Some nub probably went to MaxxPayne.com looking for a video game, and when he saw the page he saw there, he probably emailed the guy asking where the game went. MaxxPayne probably then went to MaxPayne.com, saw the ad that a new game was coming out and the old one was a big hit too, did a bit of research and saw that Remedy was making the big bucks on this one, looked over at his pile of unpayed taxes, and decided to try and get some extra money.

The scary thing is how I can't say with certainty that he'll lose. I hate the judicial system sometimes.

That disclaimer they use won't actually protect them, its something they use to stop 95% of idiots who want to cause trouble. Anyone serious enough with any half wit of a lawyer will be over that hurdle in a hurry.

Movies studios make a point of clearing names for this reason. Villians associated with real names get damages "because of mental anquish (sp?)" and such. There have been situations of characters names being changed in post production because someone saw dollars signs and the idiot spoke to soon.

Its sad, stupid and pathetic. There is also a very good chance that he will receive a decent chunk of cash outside of court.

Universal got what it deserved. They decided to make a movie based on the video game, a ****ty one at that, and forgot the movie. I hope they lose a **** load of money and the idiots get fired.
