You're reading too much tweakers.net... It simply is not true what you say, EULA's are valid as long as they are reasonable.. AND you are allowed to return the item if you do not agree with the EULA, the shopowner has to pay you back the money even if they package is opened, but remember in that case you are not allowed to copy the software (and using it) before returning it..
