I can't see how a cartoon could be classified as child porn. Nobody was hurt, molested or whatever the hell they call it in the process except maybe some copyright infringement, but that's about it.

It's not illegal to be nude, it's not illegal to be filmed nude (no matter the age) but it is illegal to be filmed/photographed underage if you are performing a sexual act. I think it all depends on the context. So finding a bunch of cp hentai, or a whole bunch of underage pictures on someones computer would probably be illegal.

I don't know about the hentai but the rest is illegal. It remains to be seen whether the context is taken into account.

Whatever the case, I get the impression the judge here took a decision because, otherwise, they had nothing against the person that was arrested.

I can't find the part that states that that's a new law or anything, only that it was the first case.
Also, if cartoons are handled like cp now, shouldn't this apply to live-action movies with underage characters (even if the actors portraying them are adults) too? I know a few A titles that would fall into that category then. "American Beauty", "L'amant" (sp?), "The Door in the Floor" with Jeff Bridges and Kim Basinger,... I'm sure there's more, but I can't recall any more off the top of my head.
Did you know that porn stars that don't look like it's impossible that they are not 18+ basically can't do their job in Germany since November?

I didn't know about that regulation for German pornstars but in my opinion it's a stupid double standard because, while it is a small controversy every time, it is still perfectly legal for underage characters to induldge in sexual activity in regular movies. Now, those pornstars don't even pretend to be underage, do they? They just look like they could be underage. Seems like a stupid regulation and who decides whether they look alright or not anyway (might be a job for me :p)?

How about the fact that modeling agencies employ girls as young as 13 ? Isn't that sending out the wrong message and being slightly hypocritical. For a pedo, it's probably like waving something tasty around and saying, no you can't touch.

I highly doubt respectable modeling agencies produce porn. If you want to show clothes for kids you need kids to show them off. Or midgets. :p
Whether a pedo likes the night-gown pics of a 13 year-old on the package of night-gowns for 13-yearolds or not is open to discussion but I'm sure most pedos like ice-cream too, so...

Oh good, I'm glad they were able to keep their fascist traditions intact over there.

What is with this horribly flawed morality legislation? I'm all for protecting minors from undue influence and the stupidity of their youth (ie: not allowing 16yo to do porn) to a reasonable degree. But CARTOONS ARE NOT PEOPLE, and people representing an age other than what they are is called acting. Sure, we're just talking about porn here (and to call 99% of porn art is stretching the limitations of generosity), but it's not harming anyone in any way.

Sigh. What a world.

Indeed, whilst i don't really care for thease cartoons, they aren't child porn, real child porn is illegal because the act of making it means that a child gets molested in the process, but a drawing? its ink on paper.. this is a textbook example of "thought crime", and as tasteless as cartoons can be, enforcing "thought crime" is even more tasteless, not to mention dangerous.
