Maps and Rights

Hello Everybody!
I am new in this forum, so I am not shure if my question has already been asked before.
I am working on a remake of an old Duke3D-Map for UT. I had this Map on an old Compilation-CD with hundreds of other Duke3D-Maps. Normally these mapfiles are coming along with a descriptionfile written by the original editor. But in the case of this mapfile it is missing.
Am I right that, in this case, nobody holds the rights of this map? What should I do, if I want to release the map?

(P.S. I hope my english is correct)

Just make the map and release it. Give props to the person, or persons, who made the map in the first place and everything should be ok. I really don't think anyone has the rights to a map if you make it for a different game & editor.

If you make it for Unreal/UT I think it goes under the "covers" section. Like when Fear Factory (lite) did a cover of the song Cars.
